Yacht lawyer in Fethiye and Göcek: who needs help?

Foreign yacht owners, buyers, sellers, charter operators, marina users and crew can face Turkish port rules alongside flag-state, ownership, customs, insurance and contract issues. A yacht lawyer in Fethiye can review them together rather than treating a transit document, marina invoice or sale contract as the whole answer.

Av. Seyfullah Yanatma works in English and Turkish and advises clients in Fethiye, Göcek and nearby ports. He works alone, so scope is defined directly with him. For arrival documents and foreign-flag wintering, read the transit log guide for yachting in Turkey.

What does yacht purchase and sale due diligence cover?

A purchase should not begin with price and finish with a signature. Av. Yanatma can organise checks of title and registry entry, seller identity and authority, mortgages, liens or other encumbrances, outstanding marina or supplier debts, technical and ownership documents, and handover. The review should also identify the yacht’s flag, customs position, insurance and intended private or commercial use.

For a yacht registered in the Turkish ship registry, the verified legal route is a written transfer agreement with notarised signatures, or completion of the written transaction at the competent ship-registry office, followed by the registry entry. Fethiye Harbour Master publishes a dedicated boat-sale appointment route. Apply that registered-ship rule only to a registered ship; an unregistered small boat, foreign registry or beneficial-interest transfer needs separate treatment. The property law service covers related ownership and title-risk work, while this page focuses on maritime assets.

A practical pre-completion checklist includes:

  1. Obtain the current registry or registration document and confirm who can sign.
  2. Request evidence of mortgages, liens, arrests, unpaid marina or repair invoices and other debts.
  3. Match the hull, engine and identifying details across registry, insurance, survey and sale documents.
  4. Check the flag, customs status, tax history and intended use with the relevant authority.
  5. Record delivery, possession, keys, original documents and insurance notification arrangements in writing.

Which yacht registration option fits a foreign owner?

A foreign individual resident in Türkiye, or a company established under Turkish law, may fall within the ownership and application framework for a qualifying commercial yacht in the Turkish International Ship Registry (TUGS), subject to statutory and technical conditions. TUGS is a special registry for qualifying commercial vessels and yachts; it is not interchangeable with the ordinary Turkish Ship Registry (Gemi Sicili) or Bağlama Kütüğü register.

A foreign individual should not be promised direct Turkish-flag registration of every private yacht. Check the yacht’s type, use, ownership structure and current Harbour Master practice before selecting a registry, flag or company structure. Where a commercial operation is intended, Av. Yanatma can coordinate the maritime review with the company and commercial work described on the company formation and commercial law service.

Can a foreign-flag yacht charter in Turkey?

Private cruising and paid charter are different legal uses. A private Transit Log does not itself authorise paid chartering or domestic passenger trips. Article 1 of the Cabotage Law reserves transporting goods or passengers from one point of the Turkish coast to another to Turkish citizens, subject to the law and any applicable legal route.

Commercial operation must therefore be analysed under the Cabotage Law and the Ministry of Culture and Tourism’s Deniz Turizmi Araçları Turizm İşletmesi Belgesi route for foreign-flag marine-tourism vehicles. The exact licence, operator, route and possible exemption depend on the vessel, flag, owner or operator structure and activity. Current confirmation from the competent Turkish authorities should be obtained before marketing a boat charter in Turkey.

Av. Yanatma can review the proposed charter model, passenger contract, operator company, crew arrangement and licensing file. A company used for the operation may also raise residence, work-permit, tax or insurance questions; separate those from the private owner’s transit arrangements.

What should a marina or yacht contract say?

Read berthing, mooring, wintering, maintenance, repair, storage and management arrangements as contracts, not only as marina rules or invoices. Review the vessel description, permitted use, berth and access, payment and security, maintenance authority, damage allocation, insurance, environmental rules, termination, removal, jurisdiction and dispute procedure. Keep the signed contract and operator’s current rules together. The work can also cover yacht-building contracts, fuel supplies, yacht management and collision evidence.

Named operator-published facilities in the Göcek and Fethiye area include D-Marin Marina Göcek, Club Marina, Marinturk Göcek Marina and Yacht Classic’s Fethiye marina. Operator names, services and contact details can change, so check current operator pages and the actual contract. A marina dispute may involve unpaid charges, damage, access, repair quality, removal or an alleged breach of operational rules; the remedy depends on the documents and evidence.

The Göcek area guide explains where local yacht and property questions usually go. For a formal port matter, Fethiye Harbour Master is an official UAB unit at Karagözler Mahallesi Fevzi Çakmak Caddesi, İskele Karşısı, Fethiye/Muğla. Its current procedure should be checked before an appointment or filing.

When can a vessel be arrested in Turkey?

In Türkiye, ship arrest is a precautionary attachment called ihtiyati haciz, not an automatic remedy for every unpaid invoice or contractual debt. The claim must fit the closed maritime-claim categories in Turkish Commercial Code Article 1352, and the applicant must satisfy procedural and security requirements under the Turkish Commercial Code and relevant civil-procedure framework.

Before seeking arrest, Av. Yanatma would need to examine the claimant’s contract, invoices, delivery or service records, communications, registry information and evidence of the maritime claim. Jurisdiction, security, notice to the Harbour Master, objections and release procedure are case-specific. If the claim is not a qualifying maritime claim, another provisional remedy may need to be considered instead.

How are yacht insurance and injury claims assessed?

An insurance claim should be built from the policy, the incident report and the evidence, not from the label “boat accident”. Preserve the policy and endorsements, survey or repair estimates, photographs, navigation or marina records, witness details, medical records, tickets, crew documents and every notice sent to the insurer. The policy’s notification requirements and exclusions should be reviewed before a repair, settlement or admission of liability.

Passenger injury or death on a Turkish boat trip is assessed under Turkish Commercial Code sea-passenger carriage and liability rules, the passenger contract and any applicable international convention. Check Türkiye’s Athens Convention and 2002 Protocol status and any convention-based limits against the current IMO treaty record for the vessel, route and incident date.

Crew injuries require a separate classification of the work or service relationship, the vessel’s operation, insurance and incident facts. A fixed compensation cap, strict-liability result or deadline should not be promised without checking the applicable contract, insurance, statute and evidence. The accident and injury claims service is the relevant next step when a person has been hurt.

What are the VAT, special-consumption tax (ÖTV) and customs risks?

VAT, ÖTV, customs and import-status consequences for a foreign-flag yacht are transaction-specific. The result can depend on the yacht, sale structure, seller and buyer, flag, customs status, import history, Turkish residence and intended private or commercial use.

Do not assume a fixed rate or exemption for a yacht transaction. Obtain a written tax and customs opinion before stating that a sale, transfer or resident-use arrangement is exempt or carries a particular charge. Av. Yanatma can identify the legal questions and documents that a specialist tax or customs review must answer.

How does a yacht matter proceed with a lawyer?

The work normally starts with a factual map: flag, registry, owner, operator, port, intended use, contract, debt, incident and urgent deadlines. Av. Yanatma then reviews the available documents, identifies the competent authority or court route, records risks and missing evidence, and agrees the legal task before drafting or negotiating.

Depending on the matter, the next steps may include a registry or title check, contract revisions, authority correspondence, a licensing file, an insurance claim, settlement discussions or court proceedings. A yacht owner should not move, charter, sell, repair or surrender a vessel in a disputed matter without first checking the effect on evidence, insurance and customs status.

What documents should a yacht owner bring?

Useful starting documents include the current registration or flag certificate, title and purchase papers, mortgage or finance documents, customs and transit-log records, marina or repair contracts, invoices, insurance policy and claims correspondence. For a charter matter, add the operator structure, crew information, passenger contract, planned route and any licence or tourism certificate.

For an injury, arrest or dispute, preserve original messages, notices, photographs, surveys, medical records, witness contacts, port reports and payment evidence. If documents are not in Turkish or English, Av. Yanatma can identify which translation, certification or authority format needs to be checked; a translation or apostille requirement should not be assumed in advance.

Timing for a yacht sale, registry application, licensing file, insurance claim or vessel-arrest application depends on the yacht’s flag and records, authority appointments, missing documents, urgency, the other party and court involvement. Confirm current administrative practice with the relevant Harbour Master, customs or tourism authority.

Fees depend on the defined task, documents and procedure. No fixed price or outcome is promised on this page. For general information about Turkish legal fees, see the lawyer fees in Turkey guide, then ask Av. Yanatma to define the proposed work and expenses for the particular matter.

Frequently asked questions

Can a foreigner register a yacht in Turkey?

A foreign resident or Turkish company may fall within the Turkish International Ship Registry framework for a qualifying commercial yacht. The answer still depends on whether the yacht is private or commercial, its flag, owner’s residence, ownership structure and chosen registry. This is not a blanket right to register every private yacht under the Turkish flag.

What should a yacht buyer check before purchasing in Turkey?

Check the registry entry, ownership and signing authority, mortgages or other encumbrances, outstanding debts, customs or tax status, technical documents and proposed transfer route. For a yacht in the Turkish ship registry, transfer normally requires a written agreement with notarised signatures or a transaction at the competent registry office, followed by the registry entry.

Can a foreign-flag yacht be chartered in Turkey?

No. A private transit document does not authorise paid chartering or domestic passenger trips. Assess the activity under the Cabotage Law and the Ministry of Culture and Tourism licensing route for foreign-flag marine-tourism vehicles. Flag, vessel, owner, operator, route and contract structure affect the analysis; obtain current authority confirmation before advertising.

How can a yacht be arrested in Turkey?

A vessel may be sought as a precautionary attachment, called ihtiyati haciz, only where the claim fits the maritime-claim categories in Turkish Commercial Code Article 1352 and the applicant meets procedural and security requirements. Review the claim, evidence, vessel registry and proposed security before applying; jurisdiction, notice, objections and release arrangements depend on the case.

Who handles an injury claim from a Turkish boat trip?

Passenger injury or death is assessed under Turkish Commercial Code sea-passenger carriage and liability rules, the contract and any applicable international convention. Crew injury needs separate review of the work or service relationship, insurance and incident facts. Preserve medical records, witness details, tickets or crew documents, photographs, reports and policy correspondence before assessing liability or limits.

Does a transit log permit domestic yacht charter?

No. The Yacht Registration Form, commonly called a Transit Log or Yat Kayıt Belgesi, records yacht arrival and operation information. It is not a paid-charter licence or permission for domestic passenger transport. Check commercial use under cabotage rules and the applicable tourism-operation certificate route.

Can you advise on VAT, ÖTV and customs for a foreign-flag yacht?

Av. Yanatma can organise a transaction-specific review, but do not assume a fixed VAT rate, ÖTV result, customs treatment or exemption from a general webpage. The outcome can depend on the yacht, flag, seller, buyer, customs status, import history and intended use. Obtain written tax and customs advice before completing a sale or resident-use arrangement.
