How much does a lawyer cost in Turkey?

Lawyer fees in Turkey depend on the legal work, procedure, value and responsibility involved. The 2026 TBB minimum tariff sets minimum listed amounts, but it is not a price list for Av. Seyfullah Yanatma and does not replace a written fee agreement for your specific matter.

How do lawyer fees work in Turkey?

Lawyer cost in Turkey is tied to the legal service, not simply to the client’s nationality or the number of pages in a file. A first consultation, a contract review, a title-deed transaction, a residence application, an enforcement follow-up and a defended lawsuit involve different work and responsibility. The sensible starting point is a written description of the work and a fee agreement that says what happens next.

For a foreign client, the quote should also separate Turkish legal work from sworn translation, tax advice, technical property inspection, accounting, notary work and bank charges. An English explanation makes the arrangement clearer, but it does not turn separate public or professional charges into one all-inclusive amount.

What is the 2026 Turkish lawyer minimum fee tariff?

The Avukatlık Asgari Ücret Tarifesi is the Turkish Bar Association minimum fee tariff. The tariff relevant to 2026 work was published in the Official Gazette dated 4 November 2025, issue 33067. Its listed minimums are useful for understanding the floor for specified work, but they are not a price list for Av. Seyfullah Yanatma and they do not predict the total cost of a complex matter.

The tariff’s row says Asliye Mahkemelerinde; TRY 45,000 should not be presented as a separate Asliye Ceza-only rate. Monetary enforcement work may instead be calculated under the tariff’s percentage section, subject to its own minimum and maximum rules. These figures are statutory minimum or awarded-fee figures, not a promise about an agreed fee, the total duration of a file or the result of a case.

Tariffs can be amended or replaced. Confirm the current tariff and the applicable row before relying on any figure found online, particularly for work beginning after a new publication.

What should a written lawyer fee agreement include?

Articles 163 and 164 of Attorneys Act No. 1136 set the boundaries for a lawyer’s fee agreement. Article 163 says the agreement should cover defined legal assistance and its amount or value; a written document makes that arrangement easier to prove. Article 164 defines the fee as the value of legal assistance, allows a percentage of the claim or awarded matter up to 25%, and prohibits agreeing a fee below the applicable minimum tariff. The written document should identify:

  • the client and the defined legal matter;
  • the work included, such as advice, drafting, negotiation, application, hearing, enforcement or appeal;
  • the fee basis: fixed, staged, hourly where agreed, or another lawful structure;
  • whether VAT is included or added at the applicable rate;
  • public expenses and third-party costs that remain separate;
  • payment dates, currency, bank charges and receipts; and
  • what happens if the scope changes, the client ends the engagement or the matter moves to another procedural stage.

A percentage-based arrangement cannot exceed 25% of the claim or awarded matter under Article 164, and a fee cannot be agreed below the applicable minimum tariff. Where there is no clear written fee arrangement, the statutory rules may determine the fee, subject to the tariff and the relevant procedure. Do not accept a verbal promise that a tariff minimum is the complete price, or that a percentage can be used without checking its legal ceiling and calculation base.

A clear scope protects both sides from a common misunderstanding: “handling my property matter” might mean one document review, the full Tapu transfer, a dispute, or a lawsuit. Ask the lawyer to name the point at which the quoted work ends.

Are VAT, court fees and expert costs separate?

Usually, a legal quote must distinguish the lawyer’s service from expenses paid to other bodies or professionals. Depending on the matter, separate amounts may include:

  • VAT on the lawyer’s service at the applicable rate;
  • court or enforcement charges and service of process;
  • notary and Land Registry charges;
  • sworn interpreter and translation fees;
  • expert, valuation or technical report fees;
  • apostille, consular, courier and document-certification costs; and
  • bank transfer or foreign-exchange charges.

The fact that an expense is necessary does not make it part of the lawyer’s fee. A written engagement can state that the lawyer advances or coordinates an expense, but the client should still receive the purpose and receipt where available. Ask whether an estimate is firm, an authority fee is current, or an amount is only a provisional forecast.

For a foreign property owner, a valuation report, translation and Tapu charges may arise alongside legal work. For a criminal or injury matter, medical records, interpreters and expert evidence may be relevant. For an enforcement file, public charges and collection calculations may change as the file develops.

What is karşı taraf vekalet ücreti?

A court may order the unsuccessful party to pay a statutory lawyer-fee amount to the successful side. This is commonly called karşı taraf vekalet ücreti (opposing-party lawyer fee). It is calculated under the applicable tariff and appears in the court’s cost decision; it is not the same as the private fee agreed between a client and their own lawyer.

The court decides costs according to the claim, result, procedural rules and tariff. A client should not assume that winning produces a full refund of their private fee, or that losing means the exact private fee of the other side becomes payable. Ask the lawyer how the engagement treats any cost award and which litigation expenses remain the client’s responsibility. No cost result should be promised before the court decides.

How can you request a useful lawyer quote?

A lawyer cannot price an unknown file accurately from a single keyword such as “property” or “divorce”. Send a concise package:

  1. State your location, nationality if relevant and the Turkish district or authority involved.
  2. Explain what happened in date order and what you want done.
  3. Copy every deadline, hearing date, payment demand or official decision exactly.
  4. Attach complete, legible documents and identify any foreign-language material.
  5. Say whether you need advice only, drafting, negotiation, representation, enforcement or an appeal.
  6. Ask for a written breakdown of included work, exclusions, VAT, public expenses, payment stages and assumptions.

If you live outside Turkey, state your time zone and whether travel is possible. A foreign client working remotely with a Fethiye lawyer may need a power of attorney, sworn interpreter or apostille; each should be identified before execution. A quote can also identify a decision point: initial document review first, then a second quote if litigation, an appeal or enforcement becomes necessary. That is more useful than an apparently low figure that excludes the action you actually need.

Common mistakes when comparing lawyer fees

Comparing only the headline figure can hide important differences. Check whether the fee is for one consultation or ongoing representation, one property or several, one hearing or the entire case, advice or attendance, and one stage or appeal. Ask whether another lawyer, translator, notary, expert or accountant is expected to work on the file.

Do not treat a low quote as proof that a lawyer will charge no additional expenses, and do not treat a high quote as proof of a particular result. A fee is the price of defined legal assistance; it is not a guarantee of a court decision, residence permit, property transfer or recovery.

The current official tariff and Attorneys Act control where an online explanation conflicts with them. Keep the signed engagement, invoices, bank-transfer receipts and public-expense receipts together, and ask for clarification before the scope changes.

Karşı taraf vekalet ücreti is the separate lawyer-fee amount that a court may place on the unsuccessful party under the applicable tariff. It is not the same as the private fee agreed between a client and their lawyer, and a court’s decision about costs cannot be promised in advance. Should a Turkish lawyer fee agreement be in writing?
